01 Acceptance of Terms

These Terms and Conditions ("Terms") form a legally binding agreement between you and Scrap Management System ("Company," "we," "us," or "our") governing your access to and use of the Scrap Management System web application, APIs, and all related services (the "Platform").

By creating an account or using the Platform, you acknowledge you have read, understood, and agree to be bound by these Terms.

02 Description of Service

The SMS Platform provides a digital management solution for vehicle scrappage operations in India, including:

• Vehicle intake registration and processing management
• Weighbridge integration and tonnage recording
• Scrap and spare parts inventory management
• Compliance documentation per MoRTH Vehicle Scrappage Policy 2021
• B2B management for Registered Vehicle Scrapping Facilities (RVSF)
• B2C portal for individual vehicle owners
• Role-based access control, audit logs, and reporting

03 User Registration & Accounts

3.1 Accuracy: You must provide accurate, complete, and current information during registration including your organisation name, yard registration number, and valid email address.

3.2 Security: You are responsible for maintaining confidentiality of your credentials. Notify us immediately of any unauthorised access.

3.3 Eligibility: You must be at least 18 years of age and authorised to conduct commercial operations in India.

3.4 Suspension: We may suspend accounts that violate these Terms, engage in fraudulent activity, or misuse the Platform.

04 Acceptable Use Policy

You agree not to use the Platform to:

• Upload false vehicle data, falsify weighbridge records, or create fraudulent compliance documents
• Reverse-engineer, decompile, or extract source code of the Platform
• Transmit malware, viruses, or harmful code
• Scrape data using automated tools without written consent
• Violate any applicable Indian law, RTO regulation, or MoRTH guideline
• Use another user's account without explicit permission

05 Intellectual Property

The Platform and all original content, features, functionality, algorithms, and technology are the exclusive property of the Company. You retain ownership of data you submit. By submitting data, you grant us a non-exclusive licence to process it solely for providing services to you.

06 Data & Privacy

Your use is also governed by our Privacy Policy, incorporated by reference. We comply with the Information Technology Act 2000 and applicable Indian data protection regulations.

07 Payment & Billing

Subscription fees are billed in advance on a monthly or annual cycle. All amounts are in INR and exclusive of applicable GST. Refunds are issued at our sole discretion in cases of service failure attributable to the Platform.

08 Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, or consequential damages. Our total liability is limited to amounts paid in the preceding 12 months.

09 Termination

Either party may terminate with 30 days' written notice. Upon termination, a data export option is available for 30 days, after which data may be permanently deleted per our retention policy.

10 Governing Law

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Ahmedabad, Gujarat, India.
